Italian powers of attorney
For some time now, the representatives of the Republic of Italy in Germany no longer need to certify powers of attorney, nor any other notarial declarations for use in Italy. The reason for this is a decree of the Italian Ministry of Foreign Affairs.
The task has been assigned to the local notary’s offices; notary Pietzcker regularly notarises deeds and powers of attorney in Italian for use in Italy. The notarisation procedure is subject to German law, while the content of the document is governed by Italian law. Thanks to a bilateral agreement between the Federal Republic of Germany and the Republic of Italy, such documents can be used in the other country without further need of legalisation.
If you would like to have such a document or power of attorney notarised, please send us an appointment request together with a draft of the document or power of attorney to procure@fiedler-law.de. The content of the draft deed or power of attorney needs to have been prepared or checked in advance by a person specialising in Italian law to ensure that it is suitable for its purpose in Italy. As soon as the draft deed or power of attorney is available, an appointment can be made.

Appointments for foreign powers of attorney are possible on Wednesdays from 5 to 6 pm and on Thursdays from 9 to 10 am.
In order to be able to draw up a cost estimate, please let us know the approximate value of the matter (e.g. in the case of a power of attorney for sale, the approximate value of the property in euros or the share of the property if it is co-owned).
The minimum cost for drawing up such a power of attorney is 100 €. If necessary, the costs for dispatch by registered mail/return receipt or by courier will also be incurred. On request, we can send the document or power of attorney to Italy. We offer two options: registered mail with return receipt (costs approx. 10 €; delivery time approx. 2-3 weeks); express courier (costs approx. 60 €; delivery time: approx. 2 working days).
